When more than one interested party wishes to submit an offer for a particular property, the seller's Agent will normally set a "Closing Date" for offers (e.g. 12.00 Noon, Friday 30th October).
This will be notified to the interested purchaser's Solicitor. If that party wishes to have his offer considered then his Solicitor will lodge a formal offer with the seller's Agent immediately prior to the Closing Date.
Any party offering at the Closing Date does not know what the other parties will be offering.
It is now accepted practice in Edinburgh and East Central Scotland to offer "subject to survey".
When the offers are opened, normally the highest will be accepted and the purchaser's and seller's Solicitors will enter into Missives in the usual way. It should be noted that the seller is not obliged to accept the highest or, indeed, any offer submitted at the Closing Date.
